MEDICOVER INTEGRATED CLINICAL SERVICE WEBSITE TERMS AND CONDITIONS (VERSION 2.0/JAN/2024)

By accessing, visiting or using our website and its applications or certain website services, personally and/or on behalf of the legal entity for which you act as agent, intermediary or employee, you expressly and unreservedly agree to the entirety of the following general terms and conditions for the use of our Website. Access to certain services may require full acceptance of specific terms in addition to these general terms.

The content of the website https://medicover-mics.com/ (hereinafter referred to as the Website) is the exclusive property and falls under the full control of the legal entity Belro Medical S.A, trading under the brand name of “Medicover Integrated Clinical Services” (hereinafter referred to as the Owner/MICS),having its headquarters at Drève Richelle, 161, 1410 Waterloo, Belgium, registered with the Belgium Trade Registry under no. 0453.278.228.

The Owner is free to amend these terms and conditions at any time to adapt them to developments in the services and/or their use. Therefore, we ask you to consult them each time you visit the Website and to take note of the latest version of these terms and conditions. The latest version is permanently available on the Website of Medicover Integrated Clinical Services. The Owner owns all intellectual property rights (including rights to databases) regarding trademarks, service marks, logos and all other materials presented on this Website, unless otherwise stated. The rights of the Owner are protected by the Belgian legislation in force.

The Website is a web portal for presenting the services offered by the Owner. To find out detailed and complete information about the services provided by the Owner, you can contact the representatives either by phone or in writing, using the contact details provided by the Owner, in section IV, Confidentiality and Security of your Personal Data.

By filling in the forms made available to visitors, interested persons may address requests, including requesting additional information on the services provided by the Owner and may make suggestions or complaints.

The access of the users to the MICS services and to request quotes or additional information, require the registration of the user with an e-mail address. This registration is moreover necessary for the transmission of communications through which MICS intends to keep you up to date with useful information and with information on the activity of the Owner, to collect tracking data (e.g. IP address, accessed links, clicks, etc.), data on the basis of which the Owner analyses the efficiency of the transmitted communications, as well as the relevance of these communications to the users of the service. In order to choose to be kept informed of the news, information, communications and activity of the Owner, the User must:
(i) agree to this document which represents the Terms and Conditions of use of the Website and agree to read the Privacy Policy detailing the purposes and manner in which his personal data are processed and
(ii) (ii) agree to receive the communications referred to above. If subsequently, the User wishes to withdraw his agreement and no longer receive communications from the Owner, he has the opportunity to unsubscribe by accessing the unsubscribe link at the end of each email communication received.

The Owner endeavours to provide information that is as accurate as possible on his Website, but cannot guarantee that this information is always up-to-date, complete or correct; the Owner is not liable for omissions, inaccuracies and inadequate updating, both through his own actions and through the actions of third-party partners who provide information. All information on the Website is provided purely for information purposes and is subject to change. Moreover, the data on the Website are not exhaustive and are subject to subsequent changes.

Without prejudice to the other provisions on liability in these Terms of Conditions, the Owner shall not be liable for indirect damages (such as a loss of market or opportunity, loss of profits or disruption of schedules) resulting from the use of the Website. Any liability of the Owner shall further be limited to the amount for which the Owner is insured.

In any case, the Owner shall not be liable for direct or indirect damage to the user’s equipment when accessing the Website as a result of either a use of equipment that does not meet the technical requirements, or a bug or an incompatibility. The Owner shall also not be liable for direct or indirect damages resulting from an unlawful operation on the personal data by third parties (data theft, viruses, hacking or other computer crimes).

The Owner has no control over those websites and the information on them and can therefore not offer any guarantee regarding the quality and/or completeness of such information on other websites. Any action or attempt likely to violate the above provisions will legitimize the Owner to exercise the right to apply to the courts legally competent to sanction such an act.

Certain parts of the content published on the Website may be provided by other parties, such as Medicover Affiliates (IMGM Laboratories GmbH). Also, within the content of the website may be included advertising sections in which advertising messages of third parties will be displayed.

III. COOKIES

The Website https://medicover-mics.com/ uses cookies, these being data stored on the user’s hard drive, containing information about him. The use of the cookie mechanism is an advantage for the benefit of visitors; it allows the storage of navigation options on the Website, such as the type of filters that apply to the display of certain pages, as appropriate.

V. SUGGESTIONS AND COMPLAINTS

Complaints and/or requests or any notifications or suggestions regarding the way of accessing the Owner’s Website are considered only based on a written address from visitors, sent in electronic format, filling in the form provided on the contact page, and you will receive an answer within the applicable time limit provided by law.

A properly filed complaint includes the person’s identification data (first and last name), as well as a description of the issue that is the subject of the complaint. At the same time, the complaint must include at least two of the following contact details: address, telephone number, fax number and e-mail address. This personal data is strictly used in order to respond to the complaints and/or requests received.

VI. LIMITED ACCESS SERVICES

Some parts of the Website (LabOne) are only accessible if you have a login and personal password or another online identifier such as a code. Access to these services may require full acceptance of specific terms in addition to these general terms.

In any case, you are solely responsible for the confidentiality of your login and password, your code or other online identifier and for any action that could be performed on your account with it. You hereby expressly agree (1) to inform MICS immediately of any unlawful use of your account and/or means of identification and/or any security breach, and (2) to ensure that you effectively disconnect from the Website at the end of each visit. In no event shall MICS be liable for any loss or damage resulting from your failure to comply with these obligations.

The personal data already in our possession and/or that you communicate to us in the context of the limited access services is subject to our Website Privacy Statement.

VII. APPLICABLE LAW AND JURISDICTION

Insofar specific legislation does not specify otherwise all disputes and claims arising from the Website or any information contained herein shall be governed by Belgian law. Consulting the Website implies that you submit to the jurisdiction of the courts of Belgium, and that you accept to bring all lawsuits before these courts only.
